UM, SHOWN THE SCREEN IS THE VARIANCE PROCESS THAT THE CITY GOES THROUGH, UH, WHEN CONSIDERING VARIANCES.

SO THIS IS A ONE STEP PROCESS, UH, THAT GOES THROUGH THE BOARD OF ZONING APPEALS.

SO A DETERMINATION IS REQUIRED TONIGHT.

THE PURPOSE OF A VARIANCE IS TO ALLOW OR CONSIDER DEVIATIONS TO DEVELOPMENT STANDARDS WHERE THERE'S EVIDENCE OF A PRACTICAL DIFFICULTY OR SPECIAL CONDITION.

UM, AND SOME OF THOSE CONSIDERATIONS ARE LISTED ON THE SCREEN AS WELL.

AND THOSE INCLUDE LOOKING AT, UH, THE SITE OR BUILDING AND SEEING IF THERE'S UNIQUE CIRCUMSTANCES, TOPOGRAPHY THAT MAKES DEVELOPMENT CHALLENGE CHALLENGING THE CHARACTER OF SURROUNDING AREA AND THE IMPACT ON ADJACENT PROPERTIES.

SO THE SITE IS HIGHLIGHTED ON YOUR SCREEN HERE.

THIS IS LOCATED IN THE OAK PARK SUBDIVISION, UH, SUB AREA.

A SUB AREA A IS ALL THE PROPERTIES THAT ARE ALONG THE PERIMETER OF THE DEVELOPMENT AND THEY ALL, MANY OF THEM DO BACKUP TO AN EXISTING OPEN SPACE RESERVE.

UM, AS IT WAS STATED IN THE REPORT, WE'VE, AT LEAST IN THE PAST, PROBABLY FIVE TO SIX YEARS, HAVE SEEN SEVERAL, UH, VARIANCES WITHIN THIS NEIGHBORHOOD, ALL WITHIN SUB AREA A.

UM, SO THIS WOULD FALL IN LINE WITH SOME OF THOSE THAT WE HAVE SEEN IN THE PAST IN TERMS OF THE REAR YARD SETBACK REQUEST AND THE VARIANCE TO THAT REQUIREMENT.

SO SHOWING THE SCREEN ARE SOME OF THE PHOTOS THAT HAVE BEEN PROVIDED BY THE APPLICANT.

UH, JUST TO GIVE YOU AN IDEA OF THE EXISTING, UH, PROPERTY, UH, YOU CAN SEE THE HOME HAS A THREE CAR GARAGE, UH, THAT'S LOCATED FORWARD.

THE BUILDING IT'S SIDE LOADED, AND THEN YOU CAN SEE THE REAR OF THE BUILDING.

UM, THE BUILDING IS, OR THE, THE MAIN STRUCTURE OF THE HOME IS SETBACK ABOUT 29 FEET FROM THE REAR PROPERTY LINE.

UM, AND THE REAR SETBACK FOR THIS SITE IS 25 FEET.

UM, AND THEN ON THAT FAR RIGHT PHOTO, YOU CAN SEE, UH, EXITING THE HOME, UH, LOOKING OUT TOWARDS THE OPEN SPACE RESERVE.

AND THEN THAT'S THE EDGE OF THE OAK PARK DEVELOPMENT AS WELL.

UH, SO THERE'S SOME SINGLE FAMILY HOMES THAT ARE OUT THERE, BUT NO OTHER DEVELOPMENT.

SO THE VARIANCE REQUEST IS TO, UH, THE 25 FOOT SETBACK FOR THE, UH, A POTENTIAL PATIO OR DECK.

SO ON THE SCREEN YOU CAN SEE THE SITE PLAN.

YOU CAN SEE APPROXIMATELY WHERE THAT 25 FOOT SETBACK WOULD LAND, WHICH IS PRETTY CLOSE TO THE BACK OF THE BUILDING.

AND THEN WHERE THEY'RE REQUESTING TO EXTEND INTO THAT SETBACK, WHICH WOULD BE ABOUT 13 FEET FROM THE REAR PROPERTY LINE.

UH, THERE IS A 10 FOOT EASEMENT THAT SITS ALONG THE REAR OF THE PROPERTY, SO THEY WOULD BE AVOIDING THAT.

UM, SO THAT'S THE BASIS BEHIND THIS REQUEST REQUESTS, UH, THE APPLICANT HAS PROVIDED THEIR STATEMENT, AND I'LL LOOK TO THEM TO, UH, PROVIDE THEIR EXPLANATION FOR THIS REQUEST WHEN WE DO GET TO THAT TIME.

BUT STAFF DID REVIEW THIS APPLICATION TO THE APPLICABLE CRITERIA AS A REFRESHER.

UM, THE THREE CRITERIA THAT ARE SHOWN ON THE SCREEN ALL HAVE TO BE MET IN ORDER FOR A VARIANCE TO BE APPROVED.

UH, THE FIRST IS SPECIAL CONDITIONS, THEN APPLICANT ACTION IN ACTION AND THEN IMPAIRING, IMPAIRING THE INTENT AND PURPOSE OF THE

REQUIREMENT.

SO, UM, STAFF REVIEWED THIS APPLICATION TO THESE CRITERIA AND FOUND, UH, FOR THE SPECIAL CONDITIONS, THE LAYOUT OF THE HOUSE AND HOW IT'S PUSHED BACK, UH, INTO THE LOT IS SOMETHING THAT DOES, UH, MAKE IT CHALLENGING TO BUILD ANYTHING, ANY AMENITY SPACE BEHIND THE HOME.

BUT ALSO POINTING OUT, AND AS WE'VE SEEN SEVERAL OF THESE, THESE VARIANCES IN THE PAST, ALL WITHIN SUB AREA, THIS IS KIND OF A DISTINGUISHING CHARACTERISTIC OF MANY HOMES IN THIS SUB AREA.

AND IT'S CONSISTENTLY CREATED CHALLENGES FOR MANY PROPERTIES, UH, IN THE NEIGHBORHOOD TO MEET THAT REAR SETBACK WHEN IT COMES TO, UH, ADDING AMENITY SPACE THAT JUST WAS NOT CONSIDERED BEFORE.

SO IT'S A CONDI SPECIAL CONDITION THAT'S APPLICABLE ONLY TO THE, THAT SUB AREA.

THE, THE INTERNAL LOTS ALL HAVE SEPARATE SETBACK REQUIREMENTS, WHICH ALLOW SIGNIFICANTLY MORE SPACE TO HAVE A PATIO OR A DECK.

I WANT TO SAY THE SETBACKS ABOUT FIVE FEET FROM THE REAR PROPERTY LINE FOR THOSE TYPES OF STRUCTURES.

SO THAT'S WHY IT IS A SPECIAL CONDITION FOR THESE OUTLYING PROPERTIES.

UH, AND THEN FOR THE SECOND SET OF CRITERIA, TWO OF THE FOUR NEED TO BE MET, STAFF HAS FOUND THAT NUMBER ONE, SPECIAL PRIVILEGES AND NUMBER THREE DELIVERY OF GOVERNMENTAL SERVICES HAS BEEN MET WITH THIS.

SO WITH THAT, UH, STAFF IS RECOMMENDING APPROVAL OF THE VARIANCE TO ALLOW FOR THE PATIO OR DECK TO ENCROACH 12 FEET INTO THE 25 FOOT SETBACK.

THE 0.23 ACRES SITE IS ZONED PUD OR PLANNED UNIT DEVELOPMENT DISTRICT OAK PARK AND IS LOCATED AT 7 0 0 7 PRIMROSE COURT.

AND I APOLOGIZE FOR NOT CATCHING THAT.

IN PART, THE, THE, THE TESTIMONY THAT WE HEARD PREVIOUSLY MATCHED TODAY IN THAT THE BUILDERS BOUGHT THE LOTS, HAD THE PLACEMENT WITH A THREE CAR SIDELOADED GARAGE THERE, CREATED BASICALLY NO OTHER PLACEMENT ON THE LOT, UM, FOR A PATIO AND THERE WASN'T ENOUGH SPACE.

IT IS, AND, AND I WILL ASK ZACH TO CONFIRM THIS, BUT IT IS UNIQUE ONLY TO THIS SECTION OF IT.

'CAUSE I THINK WE LOOKED AT IT ACTUALLY A BIG PICTURE OF IT BEFORE AND THEN WENT BACK TO THIS SECTION AND THERE IS A WALKING PATH AND A, WHAT'D YOU CALL IT? A PRESERVATION AREA? WHAT'S BEHIND IT? UM, A CODE CHANGE TO SETBACKS IS THE PREFERRED METHOD.

UM, I'D SAY AT, WITH HOW MANY VARIANCES WE HAVE DONE OUT HERE ALREADY.

UM, WE'VE KIND OF LEARNED OUR LESSON IN THIS MOMENT AND HAVE APPLIED THAT MOVING FORWARD, WHICH IS WHY WE PROVIDE A LITTLE BIT MORE DISTINCTION WITH THE SPECIAL CONDITIONS, UM, JUST TO MAKE SURE THAT, YOU KNOW, WE'RE NOT JUST SAYING, WELL, WE'VE DONE THIS HERE AND IT'S PRETTY, IT'S, YOU KNOW, IT'S PRETTY CUT AND DRY.

SO I DON'T, I WOULDN'T SAY THAT'S THE SPECIAL CONDITION OR CIRCUMSTANCE, BUT I THINK THE EXTENDED SETBACK COMBINED WITH THE OPEN SPACE AND WALKING PATH BEHIND IS ENOUGH TO LIFT IT OVER THE HUMP.
